El objetivo principal del ensayo es intentar entender el significado del silencio del Buddha ante las diez proposiciones sin declarar. Si se consideran como di††hi, las preguntas sin declarar son simplemente un conjunto de proposiciones conceptualmente distorsionadas. El trabajo se ha dividido en cinco secciones. En las dos primeras se presenta la explicación del Buddha de su propio silencio. Tienen un alcance meramente expositivo con el objeto de situar la discusión en los términos en que fue originariamente planteada. La tercera (...) parte explica los mecanismos mentales que intervienen en la generación mental de patrones mentales distorsionados. El papel que desempeña papañca en el desarrollo de las tendencias subyacentes y la aparición de efluvios mentales se ha desarrollado en la cuarta parte. Suppose one hundred prisoners are in a yard under the supervision of a guard, and at some point, ninety-nine of them collectively kill the guard. If, after the fact, a prisoner is picked at random and tried, the probability of his guilt is 99%. But despite the high probability, the statistical chances, by themselves, seem insufficient to justify a conviction. The question is why. Two arguments are offered. The first, decision-theoretic argument shows that a conviction solely based on the statistics (...) in the prisoner scenario is unacceptable so long as the goal of expected utility maximization is combined with fairness constraints. The second, risk-based argument shows that a conviction solely based on the statistics in the prisoner scenario lets the risk of mistaken conviction surge potentially too high. The same, by contrast, cannot be said of convictions solely based on DNA evidence or eyewitness testimony. A noteworthy feature of the two arguments in the paper is that they are not confined to criminal trials and can in fact be extended to civil trials. (shrink)

L'actuel regain d'intérêt pour la philosophie témoigne de l'attente la plus légitime qui soit, eu égard aux prétentions traditionnelles et à l'aura de cette discipline, mais également la plus difficile à satisfaire : qu'elle mène celui qui épouse ses chemins à une véritable réappropriation de sa propre existence, à une recréation personnelle. Impossible ici de se satisfaire d'un horizon de consolations aimables et de recettes de prospérité, non plus que de vertiges théorisants ou d'érudition monomaniaque. Face à un monde qui (...) semble avoir d'avance consumé nos élans et consommé nos révoltes, les postures et commodités ne sont plus de mise. Un retour d'authenticité s'impose à l'engagement philosophique lui-même. En fait, la mise à l'épreuve de soi est passage obligé, dès lors que de mort de Dieu en chute des idoles de remplacement, nul ne peut plus prétendre faire surgir la valeur irréductible de l'humain d'ailleurs que de l'homme... D'où la pertinence et l'attrait de l'exploration, ici proposée, des voies traditionnelles et ressorts nouveaux d'une maïeutique propre à faire naître l'homme à lui-même, à travers la mise à nu et le retrait de tous les masques que nous imposent la vie en société et le respect de ses codes. Poussant au déracinement du moi comme à une étape nécessaire au dévoilement de notre vérité, les auteurs de cet essai s'inscrivent dans la lointaine filiation de ces philosophes de l'Antiquité (Stoïciens, Cyniques) qui vivaient leur philosophie comme un travail sur soi, voire une ascèse, et dans le prolongement de tout ce pan de la pensée contemporaine qui, avec Foucault notamment, s'est employé à armer la philosophie d'un pouvoir maximal de transformation croisée de celui qui s'y adonne et du social qui l'environne. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. El trabajo tiene por objeto reflexionar críticamente sobre el retribucionismo como fin de la pena en el Estado constitucional de Derecho. Tomando como punto de partida el idealismo alemán, se analizan las reformulaciones más recientes de esta corriente de pensamiento aparentemente superada. Se propone una distinción metodológica entre los términos retribución, reprobación y venganza, en orden a la defensa de una teoría de la pena secularizada.

The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Moderation and liberalism are different and in some cases antagonistic concepts. In recent years, the view that Sieyès’s idea of constituent power is a moderate and liberal rendering of sovereignty has gained acceptance in intellectual history and constitutional theory literature. This claim is based on the premise that radical and illiberal readers of Rousseau’s idea of sovereignty, such as Robespierre and the Jacobins, were opposed to representing the general will (volonté générale). Thus, constituent power as the exercise of power by (...) extraordinary representatives to draft a constitution would be a liberal attempt at political moderation in the French revolution. In contrast to this liberal reading, my analysis shows that Sieyès’s idea of constituent power is an illiberal attempt at political moderation. Against moderate liberal theories, constituent power demands that the extraordinary representatives of the constituent assembly must will, deliberate, and act as if they were the people themselves. These representatives have absolute powers and the mandate to create a constitution but also the imperative to perceive and mirror the sovereign will. From a political theory approach, I conclude that constituent power is not a liberal idea but a key notion of moderate illiberalism that prevailed during the French Revolution. (shrink)

Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

Continuous poleward motion of microtubules in metazoan mitotic spindles has been fascinating generations of cell biologists over the last several decades. In human cells, this so‐called poleward flux was recently shown to be driven by the coordinated action of four mitotic kinesins. The sliding activities of kinesin‐5/EG5 and kinesin‐12/KIF15 are sequentially supported by kinesin‐7/CENP‐E at kinetochores and kinesin‐4/KIF4A on chromosome arms, with the individual contributions peaking during prometaphase and metaphase, respectively. Although recent data elucidate the molecular mechanism underlying this cellular (...) phenomenon, the functional roles of microtubule poleward flux during cell division remain largely elusive. Foundations of Economic Personalism is a series of three book-length monographs, each closely examining a significant dimension of the Center for Economic Personalism's unique synthesis of Christian personalism and free-economic market theory. In the aftermath of the momentous geo-political and economic changes of the late 1980s, a small group of Christian social ethicists began to converse with free-market economists over the morality of market activity. This interdisciplinary exchange eventually led to the founding of a new academic subdiscipline under the rubric (...) of economic personalism. These scholars attempt to integrate economic theory, history, and methodology with Christian personalism's stress upon human dignity, humane social structures, and social justice. This volume presents the methodological and theoretical foundations for economic personalism through a detailed investigation of human action from two different, yet complementary perspectives: from the personalist perspective of Karol Wojtyla in the Acting Person , and the free-market perspective of Ludwig von Mises in Human Action . By comparing and contrasting the viewpoints of Wojtyla and Mises, the authors develop a comprehensive praxeology capable of analyzing human action from moral and economic perspectives. Beyond Self-Interest illustrates how a unified praxeology could encourage more sustained analysis of the moral dimensions of economic activity while simultaneously softening the utilitarian prejudice of contemporary economic analysis. We study ultraproducts of finite residue rings \ where \ is a non-principal ultrafilter. We find sufficient conditions of the ultrafilter \ to determine if the resulting ultraproduct \ has simple, NIP, \ but not simple nor NIP, or \ theory, noting that all these four cases occur.

El revisionismo austríaco discutió la tesis de la historiografía económica clásica en torno a una supuesta incomprensión escolástica del mercado fundada en el �justo precio� y en la concepción aristotélica del valor, y vio en dicha concepción la raíz de la teoría subjetiva del valor sostenida por la primera generación de austríacos. Aquí mostramos, sin embargo, que los principales revisionistas austríacos realizaron una interpretación sesgada de la distinción entre valor de uso y valor de cambio en Aristóteles, e indicamos las (...) claves esenciales en torno a las cuales debería girar la recuperación de la auténtica dimensión del valor económico en Aristóteles. Many philosophers have pointed out that statistical evidence, or at least some forms of it, lack desirable epistemic or non-epistemic properties, and that this should make us wary of litigations in which the case against the defendant rests in whole or in part on statistical evidence. Others have responded that such broad reservations about statistical evidence are overly restrictive since appellate courts have expressed nuanced views about statistical evidence. In an effort to clarify and reconcile, I put forward an interpretive (...) analysis of why statistical evidence should raise concerns in some cases but not others. I argue that when there is a mismatch between the specificity of the evidence and the expected specificity of the accusation, statistical evidence—as any other kind of evidence—should be considered insufficient to sustain a conviction. I rely on different stylized court cases to illustrate the explanatory power of this analysis. (shrink)

As integrators of talents, Catholic family business leaders are strategically positioned to leverage the unique differences of their workforce. Business literature currently emphasizes participatory leadership as best practice. Participatory leadership is insufficient, however, because increasing the number of voices in the decision-making process may lead to higher levels of conflict or disengagement if the voices are disregarded. This paper proposes that the Catholic Social Teaching concepts of subsidiarity and solidarity provide the guiding principles to integrate participation because together they can (...) account for all stakeholders while advancing business goals. To operationalize these principles, this paper suggests that the dispute resolution field has developed analytical frameworks to assess and reimagine current policies, procedures, and culture for dispute resolution and shared decision making. Ultimately, businesses are the training ground to prepare citizens to participate in the public square and contribute to the common good. (shrink)
